Hours from "fiscal cliff," Washington still awaits deal

WASHINGTON (Reuters) - The Congress comes back on Monday without a deal to avert the "fiscal cliff" and with only a few hours of actual legislative time scheduled in which to act if an agreement materializes.

Negotiations involving Vice President Joe Biden and Senate Republican leader Mitch McConnell appeared to offer the last hope for avoiding the across-the-board tax increases and draconian cuts in the federal budget that will be triggered at the start of the New Year because of a deficit-reduction law enacted in August 2011.

A Republican Senate leadership aide described discussions between McConnell and Biden as "good talks," saying they lasted late into Sunday evening.

Meanwhile, some Republicans said progress could be better served by open debate rather than "backroom" discussions.

"What we ought to do is put a bill on the Senate floor and let people actually offer amendments and vote on it. We shouldn't be here waiting for people to cut deals in backrooms," Senator John Barrasso, a Wyoming Republican, said on "The Early Show" on CBS.

"The American people ought to be able to watch the discussion and debate and how people vote on various issues," he said.

A jolt from the financial markets could also prod the parties into action, as it has occasionally in the past.

"I believe investors will show their displeasure" at the lack of progress in Washington, said Mohannad Aama, managing director at Beam Capital Management, an investment advisory firm in New York.

Despite the uneven progress in Washington, U.S. stock index futures edged higher on Monday, setting up Wall Street to break a five-session losing streak. Stocks could still fall though on Monday when the cash markets open if there is no sign lawmakers are making headway on a deal.

Democratic and Republican leaders in the Senate had hoped to clear the way for swift action on Sunday. But with the two sides still at loggerheads in talks, Senate Democratic leader Harry Reid postponed any possible votes and the Senate adjourned until Monday.

The main sticking point between Republicans and Democrats remained whether to extend existing tax rates for everyone, as Republicans want, or just for those earning below $250,000 to $400,000, as Democrats have proposed.

Also at issue were Republican demands for larger cuts in spending than those offered by President Barack Obama.

Hopes for a "grand bargain" of deficit-reduction measures vanished weeks ago as talks stalled.

While Congress has the capacity to move swiftly when motivated, the leaders of the U.S. House of Representatives and the Senate have left themselves little time for what could be a complicated day of procedural maneuvering in the event of an agreement.

House Speaker John Boehner has insisted that the Senate act first, but that chamber does not begin legislative business until about noon Monday.

OTHER BUSINESS ALSO ON AGENDA

And the cliff is not the only business on the House agenda. Farm-state lawmakers are seeking a one-year extension of the expiring U.S. farm law to head off a possible doubling of retail milk prices to $7 or more a gallon in early 2013.

Relief for victims of Superstorm Sandy is waiting in line in the House as well, though it could still consider a Senate bill on assistance for the storm until January 2, the last day of the Congress that was elected in November 2010.

Expiring along with low tax rates at midnight Monday are a raft of other tax measures effecting tens of millions of Americans.

A payroll tax holiday Americans have enjoyed for two years looks like the most certain casualty as neither Republicans or Democrats have shown much interest in continuing it, in part because the tax funds the Social Security retirement program.

The current 4.2 percent payroll tax rate paid by about 160 million workers will revert to the previous 6.2 percent rate after December 31, and will be the most immediate hit to taxpayers.

A "patch" for the Alternative Minimum Tax that would prevent millions of middle-class Americans from being taxed as if they were rich, could go over the cliff as well. Both Republicans and Democrats support doing another patch, but have not approved one.

At best, the Internal Revenue Service has warned that as many as 100 million taxpayers could face refund delays without an AMT fix. At worst, they could face higher taxes unless Congress comes back with a retroactive fix.

After Tuesday, Congress could move for retroactive relief on any or all of the tax and spending issues. But that would require compromises that Republicans and Democrats have been unwilling to make so far.

Obama said on Sunday he plans on pushing legislation as soon as January 4 to reverse the tax hikes for all but the wealthy.

LANDOVER, Md. (AP) ? With the NFC East title on the line, Tony Romo threw interceptions on each of Dallas' first two possessions Sunday night, and Washington kicker Kai Forbath missed a field-goal try for the first time in his NFL career, leaving the Cowboys and Redskins tied 0-0 after the first quarter.

It was a win-or-go-home game moved into prime time to mark the end of the NFL's regular season: Whichever team lost would miss the playoffs, and the winner would host the wild-card Seattle Seahawks in a first-round game next weekend.

Washington and rookie quarterback Robert Griffin III won the coin toss, got the ball first and went three-and-out, with Dwayne Harris' 28-yard punt return setting up Dallas at the Washington 27.

But on Dallas' third play on offense, Romo's pass was picked off by Redskins rookie Richard Crawford. Walking to the sideline, Romo gave intended receiver Kevin Ogletree a talking-to.

The Redskins then drove into field-goal range, before Forbath sent his 37-yard attempt off the right upright, ending his NFL-record streak of 17 consecutive makes to begin a career. Forbath made two field goals last week to surpass Saints kicker Garrett Hartley's old mark of 16 in a row.

Dallas' second drive also ended with Romo's pass getting picked off, this time by cornerback Josh Wilson at Washington's 13. The Redskins again did not capitalize, needing to punt the ball back.

The Cowboys were seeking the first division title and playoff berth since 2009. The Redskins, meanwhile, sought their first trip to the postseason since 2007 ? and first NFC East championship since 1999. Washington finished in last place each of the past four seasons.

Washington entered the day on a six-game winning streak and with a 9-6 record, while Dallas came in 8-7.

A victory over Dallas would make Washington the first club since the 1996 Jacksonville Jaguars to get to the playoffs after opening 3-6.

Washington Could Hold Last-Minute Votes To Avoid Fiscal Cliff

With a new-year's deadline inching closer, Senate majority leader Harry Reid and minority leader Mitch McConnell are trying to hammer out a deal to avoid going over the fiscal cliff.

Reid and McConnell worked for part of Saturday to find a compromise.

They are trying to avoid middle-class tax hikes, extend unemployment benefits and delay spending cuts.

President Barack Obama said Friday if no long-term deal can be reached, he wants a simple up-or-down vote on a basic package to protect Americans.

In his weekly address, Obama was critical of lawmakers for waiting until the last minute to find common ground.

The Senate could vote on a plan as early as today if one is reached.

The House of Representatives will be back in the Capitol today in the event a vote is needed.

Without a deal, a series of automatic tax hikes and spending cuts would take effect on Tuesday.

Christopher Brauchli: And the Solution Is... More Guns

The NRA showed the importance of a thoughtful response to the tragic events in Newtown by maintaining a respectful silence until December 21, 2012 when it sent its beloved Wayne LaPierre to meet the press. Earlier in the week the organization had issued a compassionate response saying: "[W]e were shocked, saddened and heartbroken by the news of the horrific and senseless murders in Newtown. Out of respect for the families, and as a matter of common decency, we have given time for mourning, prayer and a full investigation of the facts before commenting. The NRA is prepared to offer meaningful contributions to help make sure this never happens again." The full investigation to which the NRA referred took one week since exactly one week after the murders Mr. LaPierre held a press conference.

At the press conference Mr. LaPierre offered a solution to the problem of mass slaughters in schools that was radically different from others that had been heard. He suggested that all schools should have armed guards in place to protect the students. This was a creative solution that no one else had proposed.

According to the Center for Education Reform, as of 2010 there were 132,656 K-12 schools in the United States. 5,714 charter schools, 28,220 private schools, and 7,400 Catholic schools for a total of 173,990 schools needing protection. At this point it is impossible to know how many armed guards each school would need. There are probably no school buildings that have only one door and large schools have many doors. For this discussion we can assume that each school could limit the number of open entrances to five and thus only five guards would be needed for each school. Of course if one fears a gunman who shoots through a locked door as happened in Newtown, many more would be needed. Ignoring that, however, a force of 869,950-armed guards would be required.

The need for security at 2-year, 4-year and non-degree granting colleges is no less than the need for security in K-12 schools, as the Virginia Tech massacre, among others, demonstrated. According to the National Center for Education Statistics there were 11,237 such institutions in the year 2009-2010. Since many of those institutions have scores of buildings with many entrances it is impossible to know how many armed guards will be required but it is safe to assume it is at least as many as would be required for K-12 schools. Thus, the total needed to protect all educational institutions in the country would be a least 2 million armed guards and probably considerably more. Although the NRA has addressed only educational institutions, it would surely agree that there should be armed guards in all movie theaters in the country and, given the recent shooting in a shopping mall in Portland, Oregon, at all shopping malls. When fully implemented, our security will be guaranteed by local militia comprising at a minimum 4 to 5 million armed citizens, a militia two to three times as large as the armed forces. We won't need more guns, however, since there are already in excess of 300 million guns owned by safety-minded individuals in the United States. With the militia in place there will be no need for them in the home and they can, and probably will, be donated to the newly created militia by owners happy to obtain a charitable deduction on their taxes for their donations.

Some may wonder who is going to pay for such a militia. The cost of the militia will be paid by school districts, (and indirectly by the taxpayers) and in the case of other venues, the proprietors of the protected properties will pay and pass the cost on to their customers.

As soon as the foregoing has been fully implemented there will almost certainly be no more slaughters in the protected venues. Of course, there will be the occasional exception such as the shooting at the Columbine school where notwithstanding the protection provided by two policemen guarding the school, 12 students and one teacher were killed and 21 students were injured.

The new United States will still suffer the occasional casual death attributable to the gun. During the 12 days following the Newtown shooting 222 deaths in the United States were attributed to guns and that is not unusual. The average number of people killed in the United States each day through gun related activities is 24. That is an unfortunate fact that the NRA proposal does not address (except insofar as gun owners donate their weapons to the militia) but it does not detract from the merit of its proposal. Instead of carping, we should all be grateful to the NRA for offering a solution that insures that all of us who don't accidentally get killed by the rogue gun or by being participants in a slaughter notwithstanding the presence of armed guards, can look forward to long, peaceful lives.

Drug Maker Lundbeck's Chemo Shortage Could Cost Kids' Lives

Cancer headlines, as portrayed in the media, appear to bring jaw-dropping news of breakthroughs and cures every day. Several studies have shown how mainstream outlets tend to favor positive news or positive spins on cancer. As a consequence, the general public gets the underlying impression that for this or that cancer there is surely something of late, some major development that can overcome a cancer diagnosis.

This really could not be further from the truth. Treatment success rates have improved dramatically in lymphomas and leukemia, but for many other cancers they haven't changed much in decades. Maybe 99 times out of 100 times that you see a headline about how 'mistletoe eliminates cancer cells' it is pre-clinical?meaning achieved in a dish or a mouse. A whole host of crap kills cancer cells in a dish. In the human body it's much different.

The point is that truly jaw-dropping cancer-related news?good or bad?happens as infrequently as in any other field.

It happened today. And it was bad.

The NEJM

The December 27 issue of the New England Journal of Medicine includes what could reasonably be considered among the top three or four cancer stories of 2012.

Researchers from St. Jude's Children's Hospital are reporting that their two-year cancer-free survival rate for patients with high-risk Hodgkin's lymphoma dropped from 88% to 75%. Put another way, the relapse rate went up. The reason?

A drug shortage. For reasons unknown--either a manufacturing breakdown or plain old profiteering by artificially creating an imbalance between supply and demand--the drug manufacturer Lundbeck couldn't produce enough of a specific drug, and kids suffered for it.

Whereas St. Jude's would typically include the drug mechlorethamine (trade name: Mustargen) in the treatment of these patients, when Lundbeck had a three year shortage occur, St. Jude's replaced that drug with a very old and reliable alternative, cyclophosphamide. And that's when their relapse rate began to climb.

The researchers wrote:

":We can think of no credible explanation for this dramatic difference in event-free survival other than the drug substitution."

The patients, in case it's not obvious, are kids, with half of them younger than 14.

Nobody's dead?yet. That's in part because it hasn't been long enough. But those who experienced relapse required additional treatment, and in these cases it was no ordinary additional treatment: these kids had to have radiation and high-dose chemotherapy followed by an autologous stem cell transplantation.

The question now becomes, will these patients suffer any long-term consequences because of this shortage?

Who knows ? but we do know that the more chemo you get, the better the chance you have health problems later in life. The better the chance you develop a secondary cancer later in life. Or problems with fertility. Or cardio-pulmonary problems. There's a good reason why so many people are trying to reduce the toxicity of Hodgkin's treatments?because while they are curable, it would be even better if they weren't so toxic.

The high-dose preparative chemotherapy regimens used in stem cell transplants tend to be especially nasty. Especially vomit-inducing. Especially miserable. And often, especially compromising to one's health, short and long term.

It's too soon now to know whether any of these patients will be the first documented victims of this unacceptable drug shortage, and a good lawyer could argue any such accusation away in a court of law.

Unresolved

The FDA currently regards the mechlorethamine shortage as having been resolved.Sure, the drug might be back in supply but what's unresolved is exactly why Lundbeck ran short of the drug in the first place.

New laws have since gone into effect that see to it that the FDA has some warning before a shortage occurs so it can order the drug from overseas.

But don't let that stop you from asking them yourselves.

    (AP) ? A deadline looming, President Barack Obama will meet with congressional leaders at the White House on Friday in search of a compromise to avoid a year-end "fiscal cliff" of across-the-board tax increases and deep spending cuts.

    The development capped a day of growing urgency in which Obama returned early from a Hawaiian vacation while lawmakers snarled across a partisan divide over responsibility for gridlock on key pocketbook issues. Speaker John Boehner called the House back into session for a highly unusual Sunday evening session.

    Adding to the woes confronting the middle class was a pending spike of $2 per gallon or more in milk prices if lawmakers failed to pass farm legislation by year's end.

    Four days before the deadline, the White House disputed reports that Obama was sending lawmakers a scaled-down plan to avoid the fiscal cliff of tax increases and spending cuts.

    Administration officials confirmed the Friday meeting at the White House in a bare-bones announcement that said the president would "host a meeting."

    An aide to Senate Republican Leader Mitch McConnell said the Kentucky lawmaker "is eager to hear from the president."

    A spokesman for House Speaker John Boehner issued a statement that said the Ohio Republican would attend and "continue to stress that the House has already passed legislation to avert the entire fiscal cliff and now the Senate must act."

    While there was no guarantee of a compromise, Republicans and Democrats said privately elements of any agreement would likely include an extension of middle class tax cuts with increased rates at upper incomes as well as cancellation of the scheduled spending cuts. An extension of expiring unemployment benefits, a reprieve for doctors who face a cut in Medicare payments and possibly a short-term measure to prevent dairy prices from soaring could also become part of a year-end bill, they said.

    That would postpone politically contentious disputes over spending cuts for 2013.

    Top Senate leaders said they remain ready to seek a last-minute agreement. Yet there was no legislation pending and no sign of negotiations in either the House or the Senate on a bill to prevent the tax hikes and spending cuts that economists say could send the economy into a recession.

    Far from conciliatory, the rhetoric was confrontational and at times unusually personal.

    Senate Majority Leader Harry Reid, D-Nev., accused Boehner of running a dictatorship, citing his refusal to call a vote on legislation to keep taxes steady for most while letting them rise at upper incomes. The bill "would pass overwhelmingly," Reid predicted, and said the Ohio Republican won't change his mind because he fears it might cost him re-election as speaker when the new Congress convenes next week.

    Boehner seems "to care more about keeping his speakership than keeping the nation on a firm financial footing," he said in remarks on the Senate floor.

    A few hours later, McConnell expressed frustration and blamed the standoff on Obama and the Democrats. "Republicans have bent over backwards. We stepped way, way out of our comfort zone," he said, referring to GOP offers to accept higher tax rates on some taxpayers.

    "We wanted an agreement, but we had no takers. The phone never rang, and so here we are five days from the new year and we might finally start talking," McConnell said.

    Still, he warned: "Republicans aren't about to write a blank check for anything the Democrats put forward just because we find ourselves at the edge of the cliff."

    Brendan Buck, a spokesman for Boehner, responded in a similar vein to Reid's comments. "Harry Reid should talk less and legislate more if he wants to avert the fiscal cliff. The House has already passed legislation to do so," he said, referring to a measure that extends existing cuts at all income levels.

    Addressing the GOP rank and file by conference call, Boehner said the next move is up to the Senate, which has yet to act on House-passed bills to retain expiring tax cuts at all income levels and replace across-the-board spending cuts with targeted savings aimed largely at social programs.

    "The House will take this action on whatever the Senate can pass - but the Senate must act," he said, according to a participant in the call.

    Boehner told Republican lawmakers the House would convene on Sunday evening. Majority Leader Eric Cantor said the House could be in session until Jan. 2, the day before the new congress is sworn in.

    The risk of higher milk prices stems from the possibility that existing farm programs will expire at year's end, and neither chamber of Congress has scheduled a vote on even a temporary extension to prevent a spike. There have been unverified estimates that the cost to consumers of a gallon of milk could double without action by Congress.

    The president flew home from Hawaii overnight after speaking with top congressional leaders.

    Before leaving the White House last Friday, the president had called on lawmakers to pass scaled-down legislation that prevents tax increases for the middle class, raises rates at upper incomes and renews expiring unemployment benefits for the long-term jobless. He said he still supports a more sweeping measure to include spending cuts to reduce deficits, but said they could wait until the new year.

    That capped an unpredictable week in which Boehner pivoted away from comprehensive deficit reduction talks with Obama to an aborted attempt to push legislation through the House that retained existing tax levels except above $1 million. Anti-tax Republicans rebelled at raising rates on million-dollar earners, and Boehner backpedaled and canceled the planned vote.

    Without congressional action, current tax rates will expire on Dec. 31, resulting in a $536 billion tax increase over a decade that would touch nearly all Americans. In addition, the military and other federal departments would have to begin absorbing about $110 billion in spending cuts.

    Failure to avoid the "fiscal cliff" doesn't necessarily mean tax increases and spending cuts would become permanent, since the new Congress could pass legislation cancelling them retroactively after it begins its work next year.

    But gridlock through the end of the year would mark a sour beginning to a two-year extension of divided government that resulted from last month's elections in which Obama won a new term and Republicans retained their majority in the House.

    The tax issue in particular has been Obama's first test of muscle after his re-election in November. He ran for a new term calling for higher taxes on the wealthy, and postelection public opinion polls show continued support for his position.

    Boehner's decision to support higher rates on million-dollar earners marked a significant break with long-standing GOP orthodoxy, but the resistance among his rank and file so far has trumped him as well as any mandate the president claims.

    Benedict also mentioned his hope for progress in Syria, which is mired in civil war, as well as Lebanon and Iraq.
